Shipping, Payment & Returns

1. Scope of Application

ORGANOID GmbH supplies both entrepreneurs (B2B) and consumers (B2C). Entrepreneurs within the meaning of the Austrian Commercial Code (UGB) do not have a statutory right of withdrawal. Consumers within the meaning of the Austrian Consumer Protection Act (KSchG) are subject to the mandatory provisions of the Austrian Distance and Off-Premises Contracts Act (FAGG).

The General Terms and Conditions (GTC) apply in addition.

2. Payment

Payment Methods in the Online Shop

The following payment methods are available in our online shop:

  • Credit card (Visa, Mastercard, and possibly other card providers)
    Processed via the payment service provider Mollie (integration via WooCommerce)
  • PayPal

The payment is charged immediately during the ordering process. All payment data is processed via the respective payment service providers. Organoid does not store complete credit card details.

Payment Terms

Unless otherwise agreed, delivery is made against full prepayment. For individually agreed B2B projects, alternative payment terms may be agreed in writing. In the event of late payment, default interest pursuant to § 456 UGB will be charged. Any reminder and collection costs incurred must also be reimbursed. If there are justified doubts regarding the customer’s solvency, Organoid is entitled to make delivery dependent on advance payment or the provision of security.

3. Shipping & Delivery

Delivery takes place after receipt of payment, unless otherwise agreed in writing. Stated delivery times are non-binding. Fixed delivery dates apply only if expressly confirmed in writing. Partial deliveries are permitted. Upon handover of the goods to the transport company, or in the case of agreed self-collection upon handover to the customer, the risk of loss or damage transfers to the customer. Delays caused by the transport company are outside the responsibility of Organoid.

Products are packaged securely for transport:

  • Individual orders are generally rolled and shipped in cartons; if required, on a disposable pallet
  • HPL surfaces are shipped flat on a pallet 3150 × 1400 mm

Transport costs are borne by the customer unless otherwise agreed.

4. Shipping Costs

Shipping costs are displayed separately during checkout and are charged in addition to the product price. The applicable shipping costs are determined by the delivery address. The following shipping cost regulations apply exclusively to deliveries within the European Union. Deliveries to third countries are subject to separate provisions (see below).

4.1 Austria & Germany

  • Cut-to-size goods (meter goods): EUR 35.00
  • Samples: EUR 10.00
  • Sample book: EUR 12.00

Orders with a net order value of EUR 3,001.00 or more qualify for free shipping. Free shipping applies exclusively to deliveries within Austria and Germany and does not apply to third countries.

For mixed orders (e.g. cut-to-size goods and samples), the applicable shipping flat rate will be calculated based on the product categories included, unless the free shipping threshold is reached.

4.2 EU Member States (excluding Austria & Germany)

  • Cut-to-size goods (meter goods): EUR 50.00
  • Samples: EUR 10.00
  • Sample book: EUR 15.00

The free shipping threshold of EUR 3,001.00 applies exclusively to deliveries to Austria and Germany unless expressly agreed otherwise.

4.3 Third Countries (outside the EU)

Deliveries to third countries are made ex works (EXW) from:

Risk transfers to the buyer upon provision of the goods at Organoid’s premises. Any transport costs, import duties, customs charges, or country-specific taxes are borne by the recipient.

4.4 Legally Relevant Clarifications

  • The net order value (excluding VAT) is decisive for the free shipping threshold.
  • The delivery address, not the billing address, determines the applicable shipping zone.
  • Free shipping does not apply to third countries.
  • Deviating project-specific agreements require written confirmation.

5. Returns & Right of Withdrawal

5.1 Entrepreneurs (B2B)

Entrepreneurs do not have a statutory right of withdrawal. Returns are permitted exclusively within the scope of statutory warranty claims and in accordance with the GTC. Returns require prior written approval from Organoid.

Individually cut or custom-made goods are excluded from voluntary return.

5.2 Consumers (B2C)

a) Right of Withdrawal for Standard Samples

Consumers have the right to withdraw from the contract for the purchase of standard samples within 14 days without giving any reason. The withdrawal period is 14 days from receipt of the goods. To exercise the right of withdrawal, a clear declaration must be sent to Organoid by email or letter. In the event of a valid withdrawal, payments received will be refunded within 14 days. Refunds will be made using the same payment method used for the original transaction. The consumer bears the direct costs of returning the goods. The consumer is only liable for any diminished value of the goods resulting from handling beyond what is necessary to examine their nature and characteristics.

b) No Right of Withdrawal for Custom Cut-to-Size Goods

There is no right of withdrawal pursuant to § 18 para 1 no 3 FAGG for goods that are made to customer specifications or clearly tailored to personal needs.

This applies in particular to:

  • Individually cut meter goods
  • Project-specific cut materials
  • Custom-sized natural surfaces
  • Custom-configured surface products

These products are manufactured exclusively based on the measurements specified by the customer and are not suitable for resale due to their individualization. Withdrawal is therefore excluded.

6. Warranty & Transport Damage

Statutory warranty rights remain unaffected regardless of customer status. Obvious defects must be reported in writing in accordance with the GTC. In the event of a complaint, the goods must be kept in their delivered condition and returned only after prior coordination.
